WYFF’s Taniqua Pennix covered the story:

A lawsuit filed by two separate South Carolina parents of two elementary students, who were in the same class, claims the children were sexually assaulted by other students.

The parents' attorney, Tyler Rody, said the first incident happened in November 2021 at Shoally Creek Elementary School.

"That child had already exhibited signs that were very concerning, so more should've probably been done after that November incident," he said.

Rody said enough wasn't done to protect the students when parents notified school administrators after the first incident, and the alleged abuse got worse.

"They're trying to minimize what happened. They're trying to qualify what happened, they're trying to say it's not sexual, and so nothing's been done for them. They've been trying to minimize it, and it's unfortunate," he said.

The district has also been calling for the Superintendent’s resignation due to these incidents, Bethany Fowler and Collin Riviello from WSPA NEWS7 reported:

A school board member is asking the Spartanburg School District Two Superintendent Lance Radford to step down after a lawsuit alleging sexual assault in the classroom was kept from the school board members.

“My clients were getting sexually assaulted at school and it was happening by children that the school knew were exhibiting concerning behavior,” said Tyler Rody, a Spartanburg-based lawyer representing the two children’s families in the lawsuit. “They didn’t even write up a disciplinary action for that event. They didn’t write up the student at all.”

Rody said only one of the four classmates alleged to have committed sexual assault was suspended.

“[My clients] really want widespread change in the district,” said Rody. “And they want this to not happen to other kids. [It’s] as simple as that.”

Since the lawsuit was filed in June of 2022, mediation has occurred between the plaintiffs and the school district but a settlement has not been reached. Therefore, both parties will go to court no earlier than Sept. 1.
